As conservation evolves, so does the law. And lately, we’ve seen significant changes in laws important to easement donors and their advisors.
To help safeguard you from audits and legal challenges, the Land Trust Alliance is on the case. We’ve tracked and summarized the most significant changes you must keep in mind. Captured in what we call our Practical Pointers series*, these changes stem from more than 100 tax-related court opinions that affect the deductibility of donated conservation easements.
The changes outlined in our Practical Pointers series include easement drafting tips on overall risk management, amendments, building envelopes and proceeds language, all based on recent tax and appellate court opinions. This series is essential reading for attorneys working in the land conservation space.
Also, landowners and land trusts would do well to have at least some familiarity with this material. Good conservation is a team effort, after all.
And remember that the Alliance’s conservation defense and educational services teams are available to assist you. Have a question? Ask us! Drop us a line at tlc@lta.org and you’ll hear from us shortly.
